1. Introduction and Acceptance of Terms
Welcome to Papegaai, an immersive digital storytelling platform operated by inKvest SRL (also referred to as "Inkvest", "we", "us", or "our"), a company incorporated in Belgium with its registered office at Rue Andrée Geulen 2, 1050 Ixelles, Belgium.
Papegaai offers users access to original digital content — including interactive stories, comics, narrative experiences, and mobile-first immersive productions — through a freemium subscription model, accessible primarily on mobile devices at https://www.papegaai.co/.
By accessing or using the Papegaai platform (the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Service.
We may update these Terms at any time. We will notify you of material changes where reasonably practicable. Continued use of the Service following any update constitutes acceptance of the revised Terms.
2. Eligibility and Account Registration
To access certain features of the Service, you must create an account. By registering, you confirm that you:
- Are at least 18 years of age, or are a minor with the consent of a parent or legal guardian;

- Will maintain the security of your account credentials and accept responsibility for all activity under your account;

Papegaai is a mobile-first platform delivering digital storytelling experiences, including but not limited to: interactive comics, narrative series, immersive visual stories, and episodic digital content. The Service is designed for personal entertainment and cultural engagement on mobile devices.
3.2 Freemium Model
The Service operates under a freemium model:
- Free tier: access to a selection of content at no cost;
- Paid subscription tiers: access to the full content library, premium productions, and exclusive features.
The features and content available under each tier are described on our website and may change at any time.
3.3 Content Updates and Availability
Like a subscription streaming service, our content catalogue evolves over time. We may add, modify, or remove content from the platform without prior notice. Availability of specific titles or episodes is not guaranteed. Access to content is provided for the duration of your active subscription only.
3.4 Device and Technical Requirements
The Service is optimised for mobile devices. Performance may vary depending on your device, operating system, and internet connection. We do not guarantee full functionality on all devices or browsers.
4. Subscriptions, Payments, and Billing
4.1 Subscription Fees
Paid subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selection). All prices are displayed on our pricing page and are inclusive or exclusive of applicable taxes as indicated.
4.2 Taxes and VAT
Users within the European Union may be subject to VAT in accordance with applicable EU regulations. Users outside the EU are responsible for any local taxes, duties, or levies applicable in their jurisdiction.
4.3 Price Changes
We reserve the right to adjust subscription prices. Existing subscribers will receive at least 30 days' advance notice before any price change takes effect. Continued use of the Service after the effective date constitutes acceptance of the new price.
4.4 Payment Methods
We accept major credit and debit cards and other payment methods as displayed at checkout. By providing payment details, you authorise us to charge applicable fees on a recurring basis until you cancel.
5. Cancellation and Refunds
You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, access continues until the end of the current billing period. No partial refunds are issued for unused time, except where required by applicable law.
5.1 EU/EEA Right of Withdrawal
If you are a consumer in the EU or EEA, you have the right to withdraw from a digital service contract within 14 days of conclusion, without reason, pursuant to Directive 2011/83/EU. If you have expressly requested that the Service begin before the end of the withdrawal period and content delivery has commenced, your right of withdrawal may be forfeited for services already performed.
5.2 Belgian Consumer Law
As inKvest SRL is incorporated in Belgium, Belgian consumer protection law may also apply. You may benefit from additional rights under the Belgian Code of Economic Law (Wetboek van economisch recht / Code de droit économique).
5.3 Other Jurisdictions
Users in other countries may have statutory rights under their local law that cannot be excluded. Nothing in these Terms limits or excludes any right that cannot lawfully be waived.
6. Use of the Service
You may use Papegaai for personal, non-commercial purposes only. You agree not to:
- Copy, reproduce, distribute, broadcast, or publicly display any content from the platform without our written permission;
- Screen-record, download, or otherwise capture digital content for offline use unless expressly permitted;
- Share your account credentials or allow others to access the Service under your subscription;
- Attempt to gain unauthorised access to the Service, its servers, or related systems;
- Use automated tools (bots, scrapers, crawlers) to extract content or data from the platform;
- Reverse engineer, decompile, or tamper with any part of the Service or its underlying technology;
- Use the Service in any manner that could impair, disable, or disrupt the platform or other users' experience;
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
We reserve the right to suspend or permanently terminate access for any user who violates these rules.
7. Intellectual Property
7.1 Our Content
All content available on Papegaai — including but not limited to digital stories, comics, illustrations, animations, text, audio, trademarks, logos, and user interface elements — is the exclusive property of inKvest SRL or its licensors, and is protected by Belgian and international intellectual property laws.
You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and view content solely for personal, non-commercial use via the Service. No ownership rights are transferred. This licence terminates upon cancellation or termination of your account.
7.2 Your Content (User-Generated Content)
If you submit any content to Papegaai — including feedback, comments, fan art, or other contributions — you retain ownership of that content. By submitting, you grant inKvest SRL a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and distribute your submission in connection with the operation and promotion of the platform.
You are solely responsible for any content you submit. You warrant that it does not infringe any third-party rights, is not unlawful, and complies with these Terms. We reserve the right to remove any user-generated content at our discretion.
8. Third-Party Content and Links
The Service may include content produced in partnership with third-party creators, studios, or rights holders, as well as links to external websites or services. We are not responsible for the accuracy, availability, or practices of any third-party content or platforms.
Your interactions with third-party services are governed by their own terms and policies. We encourage you to review them before engaging.
9. Privacy, Data Protection, and Cookies
We collect and process personal data in connection with your use of the Service, including account information, content consumption data, device information, and usage analytics. We also use cookies and similar technologies to personalise your experience and analyse platform usage.

10. No Guarantees and Disclaimer
The Service is provided "as is" and "as available". We make no warranties — express, implied, or statutory — regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that:
- The Service will be available at all times or free from errors or interruptions;
- Any specific content, title, or episode will remain available for any particular period;
- The Service will be compatible with all devices, operating systems, or network environments;
- Content will meet your personal expectations or standards.
We will make reasonable efforts to maintain the Service and notify users of planned outages where practicable.
11. Limitation of Liability
To the fullest extent permitted by applicable law, inKvest SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service or its content.
Our total aggregate liability for any claim arising under or in connection with these Terms shall not exceed the total subscription fees paid by you in the twelve (12) months preceding the claim.
Nothing in this Section excludes or limits liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under applicable law. If you are a consumer, your statutory rights remain unaffected.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, or for any other legitimate business reason, including discontinuation of the Service.
Upon termination, all licences granted to you under these Terms will immediately cease. Clauses that by their nature survive termination — including intellectual property rights, limitations of liability, and governing law — will remain in effect.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.
Any disputes shall be submitted to the exclusive jurisdiction of the courts of Brussels, Belgium, except where mandatory consumer protection laws in your country of residence require otherwise.

14. General Provisions
If any provision of these Terms is found to be unenforceable, it will be severed and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and inKvest SRL regarding your use of the Service.
